1. Acceptance of Terms

By accessing or using the FUNGY website, you confirm that you are acting on behalf of a registered business entity and that you have the authority to bind that entity to these terms. These terms apply exclusively to B2B (business-to-business) relationships. FUNGY does not sell products directly to consumers.

2. Services Offered

FUNGY provides white label and private label manufacturing services for medicinal mushroom products, including but not limited to mushroom powders, liquid extracts, capsules, shots, and adaptogen drinks. All products are manufactured in our EU-registered, GMP-certified facility in accordance with applicable European food safety regulations.

3. Inquiries and Sample Requests

Submitting a contact form or sample request through this website does not constitute a binding order or contract. All inquiries are subject to review and acceptance by FUNGY. FUNGY reserves the right to decline any inquiry or sample request at its sole discretion. A binding contract is only formed upon written confirmation from FUNGY.

4. Pricing and Quotations

All prices and quotations provided by FUNGY are indicative only and subject to change without notice until a formal written agreement is signed by both parties. Prices are quoted exclusive of VAT and any applicable customs duties or import taxes, which are the sole responsibility of the buyer.

5. Intellectual Property

All content on this website, including but not limited to text, images, logos, formulations, and branding, is the exclusive property of FUNGY or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this website without prior written consent from FUNGY. For private label clients: upon full payment of all agreed fees, FUNGY assigns to the client all intellectual property rights in the custom formulation developed exclusively for that client. White label formulations remain the exclusive property of FUNGY.

6. Confidentiality

Any proprietary information, formulations, pricing, or business terms disclosed by FUNGY during the course of a business relationship shall be treated as strictly confidential by the recipient. This obligation of confidentiality survives the termination of any business relationship and shall remain in force for a period of five (5) years.

7. Limitation of Liability

To the maximum extent permitted by applicable law, FUNGY shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of this website or from any business relationship arising therefrom. FUNGY's total liability in connection with any claim shall not exceed the total fees paid by the client to FUNGY in the twelve (12) months preceding the claim.

8. Disclaimer of Warranties

This website and all information contained herein are provided on an 'as is' basis without warranties of any kind, either express or implied. FUNGY does not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. Product specifications and formulations described on this website are indicative and may be subject to change.

9. Regulatory Compliance

FUNGY manufactures products in compliance with applicable EU food safety and supplement regulations. However, it is the sole responsibility of the client to ensure that the products they order comply with all applicable laws and regulations in their target markets, including but not limited to labelling requirements, health claims legislation, and import regulations.

10. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the European Union and the applicable national laws of the country in which FUNGY is registered. Any disputes arising from these terms or from any business relationship with FUNGY shall be subject to the exclusive jurisdiction of the competent courts in FUNGY's country of registration.

FUNGY reserves the right to update or modify these Terms of Service at any time without prior notice. The date of the most recent revision is indicated at the top of this page. Your continued use of this website following any changes constitutes your acceptance of the revised terms.
